The case filed by the 16 Plateau lawmakers sacked by the Court of Appeal in Plateau seeking a review of the Appeal Court judgement sacking them as members of the Plateau State House of Assembly has suffered a huge setback, as the application was dismissed for lacking in merit.
The court in it's wisdom dismissed the case in totality for waste of judicial time and imposed a fine of 8 million Naira to be paid by each of the 16 former members in the suit filed before the it.
You'll recall that on 24th November, 2023, the Appeal court nullified the election of all the 16 members of the Plateau State House of Assembly, elected under the platform of the People's Democratic Party (PDP) and declared the first runner ups be issued Certificate of Return by the Independent National Electoral Commission. These comprise of 15 members-elect from the APC and 1 from the Labour Party (LP).
With this development, all is now set for the Speaker of the House, Rt Hon Gabriel Dewan to swear in the 16 members-elect.
You'll recalled that the Speaker in a comic decision declared that he recognizes only 7 members of the house immediately after the Supreme Court declared Governor Caleb Mutfwang as Governor of Plateau State on 12th January, 2023. He made the assertion that he'll only recognize the 16 members elect after the court must have interpreted the judgement of the Appeal Court.
Therefore, the uncertainty surrounding the judgment of the Appeal court as insinuated by the speaker has been put to rest
